Kenny E. Atkin, Esq.
Kenny, as he is known to his friends, family and clients, was born and raised in Utah. After attending the University of Utah for his B.S., he attended the University of Utah Law School and received his J.D. He was admitted to the Utah State Bar in 1998.

While pursuing his undergraduate studies he worked as an intern for the Curators Office of the Supreme Court of the United States. After his time in Washington D.C., he realized Utah was where he wanted to stay. During law school he worked at Atkin & Associates assisting in our handling of workers compensation claims. In 1998 he joined us as an associate and in 2003 he became a partner.

In the 15 years he has been practicing, he has handled corporate litigation, contract law, and personal injury claims. He has argued cases in front of the Utah Court of Appeals as well as the U.S. District Court. Currently his practice concentrates solely on workers compensation and related third party claims.

Kenny is an member of the Utah Association of Justice. Furthermore, he is a frequent lecturer and writer. He has lectured or written on matters ranging from the basic, such as the burden of proof in a workers compensation claim, to the very complicated matter of Workers Compensation and the overlap with ERISA insurance claims.

One pivotal case he argued at the Utah Court of Appeals involved a long standing abuse by insurance companies. The case involved a worker that was denied benefits solely due to the existence of a preexisting condition. However, this decision clarified that insurers have the burden of proof to show a preexisting condition contributed to the injury in order for any higher standard to apply. This victory not only provided benefits to our client, but also paved the way for an ultimately successful Permanent Total Disability claim. (Utah Auto Auction and/or American Home Assurance v. Labor Commission and Douglas R. Davis, 2008 UT App 293).
